Heard learned counsel for the petitioner and learned A.G.A. for the respondents.
The petitioner has preferred this petition for quashing of the F.I.R. dated 16.01.2020 registered as Case Crime No.26 of 2020 under Sections 406, 420, 467, 468, 471, 120 I.P.C., Police Station Khair, District Aligarh.
The submission of learned counsel for the petitioner is that the petitioner was simply a Manager and that he has not committed any fraud of cheating the public.
The allegations made in the first information report reveal commission of a cognizable office and since at the relevant time the petitioner was Officer-In-Charge of the Company it cannot be said that he is totally unconnected with the incident. Accordingly, we do not consider it to be a fit case for quashing the F.I.R.
Accordingly, the writ petition is dismissed without prejudice to the right of the petitioner to apply for bail/anticipatory bail in accordance with law.
In case any bail application is filed by the petitioner, it shall be considered by the Court concerned most expeditiously in accordance with law.
