By the judgment impugned dated 5th May, 1983, learned Sessions Judge, Shahjahanpur convicted the accused appellantRajendra Singh, son of Badam Singh, for an offence punishable under Section 302 I.P.C. and awarded sentence to undergo imprisonment for life term.
The Chief Judicial Magistrate, Shahjahanpur under a communication dated 26th February, 2019 has informed this Court that the accused appellant-Rajendra Singh, son of Badam Singh, resident of Shahjahanpur, within the jurisdiction of Police Station Khudaganj, District Shahjahanpur, has already died on 17th April, 2017. The fact informed to the Court is substantiated by report given by Station House Officer, Police Station Khudaganj, who made necessary enquiry in this regard. The report of Station House Officer is supported by a death certificate issued by the competent authority.
Having considered the facts stated above, we are satisfied that the sole appellant-Rajendra Singh, son of Badam Singh, has already died. Accordingly, the appeal stands abated.
