Heard Sri Kamal Krishna, learned Senior Advocate assisted by Sri S.B. Kunwar, learned counsel for the applicant, Sri K. N. Singh, learned counsel for the informant as well as learned A.G.A. for the State and perused the record.

The present bail application has been filed by the applicantRanjeet Singh @ Bagi in Case Crime No. 119 of 2019, under Section 302 I.P.C., Police Station- Bansdeeh Road, DistrictBallia with the prayer to enlarge him on bail.

Submission of the learned counsel for the applicant is that the applicant has been falsely implicated in the present case. It has been argued that the applicant is not nominated in the cognizable report lodged on 20.9.2019 by the owner of the liquor shop and the deceased has been murdered by some unknown persons. After three days of lodging of the report, on 23.9.2019 an application was moved by the mother of the deceased wherein she suspected the hands of applicant and three other accused that the applicant had extended threats a day before the deceased was eliminated. It is next contended that co-accused Rajesh Singh and Ravindra Singh @ Jhabar have been enlarged on bail by the coordinate Bench of this Court vide orders dated 3.1.2020 and 2.1.2020 passed in Criminal Misc. Bail Application Nos. 57268 and 56803 of 2019, respectively. There is no early prospect of conclusion of trial. So, the applicant, who is in jail since 25.9.2019, having no criminal history to his credit, deserves to be released on bail.

Per contra, learned A.G.A. as well as learned counsel for the informant have vehemently opposed the prayer for grant of bail to the applicant and submitted that there was no reason for false implication of the applicant in the present case and the first informant has specifically stated in the application moved on 23.9.2019 that the applicant had extended threat to the deceased that he will be done to death. Therefore, there is very strong motive for the applicant to eliminate the deceased as he had

made complaints about the misdeed of the applicant to the owner of the liquor shop.

Considering the facts and circumstances of the case as also the submissions advanced by learned counsel for the parties, without expressing any opinion on merits of the case, I am of the view that the applicant is entitled to be released on bail.

Let applicant- Ranjeet Singh @ Bagi be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the court concerned subject to following conditions that:-

1.The applicant shall not tamper with the prosecution evidence;

2.The applicant shall not pressurize the prosecution witnesses;

¶14

3.The applicant shall appear on the date fixed by the trial court.

In case of default of any of the conditions enumerated above, the courts below shall be at liberty to cancel bail of the applicant.
