Supplementary affidavit filed by learned counsel for the applicant today in the Court is taken on record.

Heard learned counsel for the applicant, learned A.G.A for the State and perused the record.

The present bail application has been filed by the applicant in Case Crime No. 455 of 2019 under Section 3/5/8 of U.P.Prevention of Cow Slaughter Act, Police Station Sahaswan, District Badaun, with the prayer to enlarge the applicant on bail.

It has been argued by learned counsel for the applicant that applicant is innocent and he has been falsely implicated in the present case. Applicant has not been arrested at the spot and his involvement has been shown on the basis of statement of coaccused person. It was further submitted that there is no independent witness of alleged recovery. It was further submitted that co-accused persons namely, Akram and Sohel, have already been granted bail by co-ordinate Bench of this Court vide order dated 28.11.2019 26.11.2019 passed in Criminal Misc. Bail Application Nos. 52806 and 52020 of 2019. It was further submitted that applicant is languishing in jail since 16.12.2019 and in case, applicant is released on bail, he will not misuse the liberty of bail and will cooperate in the trial.

Learned A.G.A. has opposed the prayer for bail.

Keeping in view submissions of learned counsel for the parties, period of detention of the applicant and all the attending facts and circumstances of the case, without expressing any opinion on the merits of the case, at this stage, prima facie, a case for bail has been made out.

Let applicant Raju @ Armaan involved in the aforesaid crime be released on bail on furnishing a personal bond and two sureties each of the like amount to the satisfaction of the court

concerned subject to the following conditions:-

The applicant will not tamper with the evidence during trial.

The applicant will not pressurize/intimidate the prosecution witnesses.

¶15

The applicant will appear before the trial court on the date fixed, unless personal presence is exempted.

The applicant will not try to contact, threat or otherwise influence the complainant or any of the witness of the case.
