Heard Sri Lalit Kumar Shukla, learned counsel for the applicant, Sri Chandraprakash Tripathi holding brief of Sri Bindeshwari Prasad Mishra, learned counsel for the informant, Sri Pankaj Saxena, learned Additional Government Advocate for the State and perused the records.

The applicant is seeking bail in connection with Case Crime No.- 284 of 2019, under Sections 420, 406, 504, 506, 120-B I.P.C., Police Station- Sadar Bazar, District- Mathura.

The informant in the first information report has complained of being defrauded for a sum of Rs.2,00,000/- in the name of providing job.

Learned counsel for the applicant has argued that there is no mode of payment demonstrated in the first information report nor, there is any evidence directly supporting the alleged transaction of the money between the parties. It is further argued that after completing the investigation the charge sheet has been submitted by the police in the matter. It is also argued that there is criminal history of two cases to the credit of the applicant and in respect of one case bearing Case Crime No.666 of 2019, the applicant has already been granted bail by this Court vide order dated 22nd November, 2019 in Criminal Misc. Bail Application No.- 51528 of 2019 which has been brought on record, whereas in respect of the other case bearing Case Crime No.- 284 of 2019, the applicant has already applied for bail. It is lastly argued that the applicant is languishing in jail since 23.08.2019.

Learned Additional Government Advocate has though opposed the prayer for grant of bail but could not dispute the aforesaid facts.

In view of overall facts and circumstance of the case, the Court

is of the opinion that the applicant is entitled to be admitted to bail.

Accordingly, applicant namely, Akash, is admitted to bail in the aforesaid case and he shall be released on bail on furnishing a personal bond and two sureties each of the like amount to the satisfaction of the court concerned.

It is further provided that this bail order available on the official website of the High Court will be taken to be the authentic one and certified copy shall be submitted before the court concerned as soon as it is issued.

It is further directed that the applicant shall not misuse the liberty of bail and shall cooperate with the police/ investigating agency/ trial as the case may be.

In view of the aforesaid, the bail application stands disposed of.
