Heard learned counsel for the applicant, Shri Gyan Prakash, learned Senior Counsel, A.S.G.I. appearing for C.B.I. assisted by Shri S.K. Yadav, learned Additional Government Advocate and perused the record.
This bail application has been filed on behalf of the applicant involved in Case Crime No. 838 of 2016, under Sections 395, 397, 376D, 342, 120B, 34 IPC and 4 POCSO Act, P.S. Kotwali Dehat, District Bulandshahr.
It is reported by the office that notice has been served upon opposite party no. 2.
As per prosecution case, victim, aged about 13 years, abducted by 5- 6 unknown persons, was gang raped; F.I.R. was lodged against unknown persons; medical report substantiates commission of the offence; name of the applicant surfaced during investigation; applicant was identified by the victim in presence of the Magistrate.
