Heard learned counsel for the applicant, learned A.G.A. for the State and perused the entire record.

This is the second bail application on behalf of the applicant. His first bail application was rejected by this Court, vide order dated 04.12.2019, passed in Criminal Misc. Bail Application No. 46707 of 2019.

This second bail application has been filed by the applicant in Case Crime No. 339 of 2019, under Section 302 of IPC, Police Station Badagaon, District -Varanasi with the prayer to enlarge the applicant on bail.

The first information report of the incident was lodged by the informant against the present accused along with other coaccused Ashutosh Yadav, alleging therein that when husband of the informant deceased Ram Prasad had gone to his field to look after the field in routine manner on 18.6.2019 he was done to death by sharp edge weapon at about 11:00 p.m. and when the informant heard noise, which was emanating from the place of occurrence, then the informant along with her sons Vinod and Manoj ran towards the field and saw that the husband of the informant was lying dead on a cot. It was further mentioned in the FIR that they saw co-accused Bhim alias Arvind son of Lalji Yadav, resident of Gaddopur and his friend the present accused who were running towards the river. They were seen in the light of torch and we tried to chase them but the accused persons managed to escape.
