As per the first information report, role of firing on the deceased was attributed to the applicant along with other coaccused Monu alias Vivek. The accused-applicant is in jail since 17.7.2018 and the trial is pending in which from the side of the prosecution four witnesses namely, Smt. Manju, PW-1informant, PW-2 Smt. Anju daughter-in-law of the deceased, PW-3 Smt Usha sister of the informant and PW-4 Vishal son of Smt. Usha have not supported the prosecution version and have been declared hostile. Copy of the statements of the said witnesses has been appended as Annexure-6 to this Bail Application. Except the aforesaid four eye witnesses, there is no other eye witness to support the prosecution case, therefore, possibility of conviction of the applicant before the court below is quite bleak. It is further contended by learned counsel for the applicant that co-accused Monu alias Vivek had already been enlarged on bail by this Court vide order dated 20.12.2019 passed in Criminal Misc. Bail Application No.6719 of 2019 and the applicant is entitled to bail on the ground of parity.
