The contention as raised at the Bar by learned counsel for the applicants is that applicants are innocent and have been falsely implicated in the present case. It is further submitted that initially an NCR was lodged by the police against accused Prakash Singh @ Om Prakash Yadav, Sanjay, Rajesh and Jitai (all sons of Hari). Later on, when the deceased Chandrika died, then, report against seven persons was lodged. It is further argued by the learned counsel that there is a cross version of the incident and a cross case was registered by the concerned police against the present complainant side, namely, Ajay, Arun, Subedar and Anand in respect to the injuries caused to informant Om Prakash Yadav and others, which was registered as Case Crime No. 87 of 2020 under Sections 323, 504, 506 IPC. It is also argued by the learned counsel that the main role of assault to the deceased has been assigned to co-accused Jitai Yadav, Ram Anjore and Sanjay Yadav. It is also submitted that co-accused Prakash @ Om Prakash who was also named in the NCR has been granted bail by another bench of this Court, vide judgement and order dated 10.11.2020 in Criminal Misc. Bail Application No. 27190 of 2020, a copy of the bail order has been submitted by the learned counsel for applicants which is taken on record. Lastly, it is argued that the applicants are in jail since 24.08.2020 and that in case they are enlarged on bail, they will not misuse the liberty of bail.
