Interestingly when first 161 Cr.P.C. statement was recorded on 23.05.2020, the informant has again reiterated the story mentioned in the FIR that for unspecified amount of money was demanded and for this her daughter was tortured and maltreated and thereafter she was killed by the accused persons. Sensing this blunder again, he has given his second 161 Cr.P.C. statement on 31.05.2020, in which for the first time he has mentioned that there was demand of Rs. 5 lakhs, motorcycle and chain was demanded as additional dowry. It is also contended by the counsel that the deceased died on account of handing. There is singular ligature mark around her neck, except this, there is no other injury over her person. It is lastly contended that the applicant resides in order to buttress his contention learned counsel for the applicant has drawn the attention of the Court to the Ration Card of Vidya Devi which is annexed as Annexure-12 of the application which clearly shows that the applicant has distinct and different unit from her daughter in law/deceased. The husband is languishing in jail. There is no dying declaration of the deceased and the case of the applicant/mother-in-law is distinguishable from the husband/Dilip alias Pappu.The applicant is in jail since 29.05.2020 and has no criminal antecedents except the present one.
