Heard learned counsel for the applicant and learned AGA for the State.
The instant bail application has been filed on behalf of the applicant, Ranju Kumari, with a prayer to release her on bail in Case Crime No. 0428 of 2016 under Sections 419, 420, 467, 468, 471, 120-B I.P.C., Police StationKotwali Shahar, District- Mirzapur, during pendency of trial.
The allegation against the applicant is that she obtained appointment on the post of Assistant Teacher on the basis of fabricated credentials.
Learned counsel for the applicant has submitted that she has been falsely implicated in this case. She never furnished any such fabricated document. She is employed somewhere else. The applicant has no criminal history to her credit and is in jail since 11.06.2020.
Learned A.G.A. has opposed the bail prayer of the applicant but could not dispute the aforesaid fact.
Having considered the material on record, larger mandate of the Article 21 of the Constitution of India and the dictum of Apex Court in the case of Dataram Singh Vs. State of U.P. and another, reported in (2018) 3 SCC 22 and without expressing any opinion on the merits of the case, let the applicant involved in the aforesaid crime be released on bail on her furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions that :-
In case of breach of any of the above conditions, it shall be a ground for cancellation of bail.
