By means of this application the applicant Ajam has prayed to release him on bail in S.S.T. No. 5 of 2019, arising out of Case Crime No. 499 of 2018, u/s 392, 411 I.P.C., P.S. Tirwa, District Kannauj.

Heard learned counsel for the applicant and learned AGA representing the State. Perused the record.

Learned counsel for the applicant has argued that the applicant is innocent and has been falsely implicated in this very case crime number, which was got registered against unknown persons. Co-accused Pramod and Babban @ Satish have been enlarged on bail by a coordinate Bench in Criminal Misc. Bail Application No. 4290 of 2019. Accusation against applicant is of same degree of above co-accused, who have been enlarged on bail. The alleged criminal history are of the same date of occurrence. Prior to it there is no criminal antecedent. He is languishing in jail since 11.10.2018. There is no likelihood of applicant's fleeing from course of justice or tempering with evidence, in case he is released on bail. Hence bail has been prayed for.

Learned AGA has vehemently opposed the bail application, but could not oppose the grant of bail to co-accused persons in this very case crime number by a coordinate Bench of this court vide order dated 30.1.2019.

Having heard learned counsel for both the parties, gone through the material placed on record, nature of accusation, severity of punishment in case of conviction and nature of supporting evidence, reasonable apprehension of tampering with the witness and prima facie case as well as grant of bail to coaccused persons in this very case crime number by a coordinate Bench of this court and without commenting on merit of the case, a case for bail is made out.

Let the applicant, Ajam, involved in above mentioned case crime number be released on bail on his executing a personal bond and two reliable sureties each in the like amount to the

satisfaction of the court concerned subject to the following conditions:

The applicant will not tamper with the evidence.

¶13

The applicant will not indulge in any criminal activity.

¶14

The applicant will not pressurize/intimidate the prosecution witnesses and co-operate in the trial.

The applicant will appear regularly on each and every date fixed by the trial court unless his personal appearance is exempted through counsel by the court concerned.

In the event of breach of any of the aforesaid conditions, the court below will be at liberty to proceed to cancel his bail.
