It is contended by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. As per prosecution case the daughter of complainant namely, Priyanjala Bind, aged about 14 years, was being enticed away by the Pappu Bind and his friends namely, Mukesh Bind and Vikky Bind (applicant). In the mid of way, all have been stopped by the complainant and other family members. When they were stopped by the complainant and his family members, they started committing mar peet with the complainant, any how the complainant and other family members took them to the police station where they were arrested by the police. It is next contended that co-accused Mukesh has been enlarged on bail by the co-ordinate Bench of this Court in Criminal Misc. Bail Application No. 34116 of 2020 vide order dated 9.11.2020. The case of the applicant stands on identical footing, hence the applicant is also entitled for bail on the ground of parity. The applicant is in jail since 11.8.2020 and if he is released on bail, there is no chance of his absconding or misusing the liberty of bail or tampering with the prosecution witnesses.
