Learned counsel for the applicant submits that according to the FIR on 21st June, 2020 applicant enticed away the victim aged about 15 years. In statement under Section 161 Cr.P.C., victim has stated that applicant enticed her and by threatening committed rape upon her. In statement under Section 164 Cr.P.C., victim has stated that on the 28th of the previous month applicant committed forceful act upon her and asked her to marry, on refusal by the victim he threatened to kill her family members and forcefully established physical relationship with her many times. He submits that as per school record, date of birth of the victim is 1st April, 2002 according to which at the time of incident she was major about 18 years. As per medical report, age of the victim has been ascertained above 16 years and below 18 years in which either side variation of two years is possible and favourable to accused will be considered. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that there is no criminal history of the applicant and he is languishing in jail since 24.06.2020.
