Learned counsel for the applicant submits that as per F.I.R., no specific role has been assigned to the applicant; the applicant has been falsely implicated in the present case; the applicant claims parity with co-accused, namely, Shailendra @ Shailu, Shekhar @ Bhondi and Talewar, who have been enlarged on bail by co-ordinate Bench of this Court vide order dated 27.2.2020, 7.9.2020 and 19.6.2020 passed in Crl. Misc. Bail Application Nos. 1284 of 2020, 23482 of 2020 and 14083 of 2020 respectively and role of the applicant is identical to that of co-accused, hence the applicant is also entitled to be released on bail. Moreover, there is no prospect of trial of the present case being concluded in near future due to heavy dockets. It is next submitted that there is no possibility of fleeing away of the applicant from the judicial custody or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is also contended that the applicant is languishing in jail since 17.1.2019.
