Heard Sri Abhijit Mishra, learned counsel for the applicant and learned A.G.A. and perused the record.
The instant bail application has been filed for releasing the applicant on bail in Case Crime No. 107 of 2020, under Sections 364, 511 I.P.C., P.S. Shikohabad, District Firozabad, during the pendency of trial.
Learned counsel for the applicant submitted that applicant is innocent and he has been falsely implicated in the present case. It is further contended that applicant is in jail since 13.03.2020 having no criminal history. In fact he is a 'Kabadi' and therefore, the presence of bag with him is natural.
On the other hand, learned A.G.A. has opposed the prayer for bail and submitted that in her statement recorded under Section 164 Cr.P.C., victim clearly made allegation against the present applicant for the aforesaid offence and there is no occasion for false implication of the applicant.
