It is contended by the learned counsel for the applicant that the applicant is wholly innocent and has been falsely implicated in the present case by the police personnel. It is next contended that some quarrel took place between the applicant and police personnel of the concerned police station resulting of which a false and fabricated first information report has been lodged by the police. Nothing incriminating has been recovered from the possession of the applicant or at his pointing out. It is further contended that the applicant does not have any criminal history. It is contended that co-accused persons, namely, Sheelu Yadav @ Amit Pratap Singh, Sonu Pal and Shivam Pal @ Sohan Pal, having an identical role, has already been granted bail by this Court on 8.9.2020, 31.8.2020 and 1.9.2020 in Criminal Misc. Bail Application Nos. 23728 of 2020, 24533 of 2020 and 24746 of 2020 respectively. It is next contended that there are no chances of the applicant of fleeing away from the judicial process or tampering with the prosecution evidence. It is next contended by the learned counsel for the applicant that the applicant is in jail since 7.6.2020 and in case he is enlarged on bail, he will not misuse the liberty of bail.
