Heard learned counsel for the applicant, learned A.G.A and perused the record.

Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the present case due to ulterior motive.It has further been submitted that the alleged recovery shown by the police against the applicant is totally false and baseless as the same has been planted by the police in arbitrary manner. There is no independent witness of the occurrence and all the witnesses are police personnel. It has further been submitted that co-accused Ram Khelawan, Chirauji Lal and Mukesh having identical role have already been released on bail by another bench of this Court vide orders dated 24.6.2020 and 22.6.2020 in Criminal Misc. Bail Applications No. 17004 of 2020 and 15911 of 2020 respectively, therefore the applicant is also entitled for bail on the ground of parity. There is no criminal history of the applicant and is in jail since 5.4.2020.

Per contra, learned A.G.A opposed the prayer for bail but could not dispute the fact that co-accused Ram Khelawan, Chirauji Lal and Mukesh having identical role have already been released on bail.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, I find it a fit case for bail.
