Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case due to enmity by the Junior Engineer of Power Corporation concerned for harassment. He has committed no offence. Prosecution story is false and fake. There is no independent witness to support the prosecution case. Nothing has been recovered from the possession of applicant. There are major contradiction between the prosecution story and statement under Section 161 Cr.P.C. Applicant is in jail since 11.12.2019 and having no criminal history against him. It is further submitted that there is no possibility of the applicant's fleeing away from the judicial process or tampering with the witnesses. In case, the applicant is enlarged on bail, he shall not misuse the liberty of bail. Due to heavy pendency of cases in the Court, there is no possibility of early conclusion of the trial. Lastly he submits that co-accused persons, namely, Raman Yadav, Pradeep Yadav and Amit Yadav have already been granted bail by the Court below in their respective bail applications and their bail orders have been annexed with the affidavit filed in support of present bail application as annexure nos.8, 9 and 10 respectively.
