Heard learned counsel for the applicant, learned AGA and perused the record.

Learned counsel for the applicant submits that the applicant has been summoned to face trial in a complaint case. The coaccused Panna Devi and Rajaram have already been enlarged on bail by the court below in this complaint case. Prior to the alleged incident one F.I.R. was lodged by the mother of the victim under sections 363 and 366 I.P.C. In that case chargesheet was not submitted against the applicant. The victim was given in the supurdgi of her mother. False story has been concocted by the complainant. There is no criminal history of the applicant and is in jail since 27.2.2020.

Per contra, learned AGA opposed the prayer for bail.

Having given my thoughtful consideration to the submissions of the learned counsel for the parties, without expressing any opinion on the merits of the case, I am of the opinion that it is a fit case for bail.

Let the applicant Arun involved in Complaint Case No. 06 of 2019, under Section 363 IPC and 7/8 POCSO Act, Police Station Sukhpura District Ballia be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions;
