Heard Sri Pankaj Kumar Gupta, learned counsel for the applicant through Video Conferencing, learned A.G.A. for the State who is present in Court and perused the record.

This bail application has been moved through E-filing on behalf of applicant Maruf who is involved in Case Crime No. 209 of 2020, under section 307 IPC, P.S. Hayat Nagar, District Sambhal.

Learned counsel for the applicant submits that applicant is innocent and has falsely been implicated in the present case. The police party took away the applicant from his house and thereafter caused gun shot injury to him. It has further been submitted that injury of injured constable Rahul is superficial and simple in nature. False recovery has been planted against the applicant. No such incident has taken place. False story has been concocted by the prosecution. The criminal history of the applicant has been explained in para 14 of the affidavit filed in support of bail application. The applicant is languishing in jail since 4.6.2020.

Per contra; learned A.G.A. has opposed the prayer for bail.

Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, I find it a fit case for bail.

Let the applicant Maruf who is involved in the aforementioned Case Crime Number be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:

The applicant will not tamper with the evidence.

He shall not pressurize/intimidate the prosecution witnesses and shall cooperate with the trial.

He shall appear on each and every date fixed by the trial

court unless personal appearance is exempted by the court concerned.

In case of breach of any conditions mentioned above, the trial court shall be at liberty to cancel the bail of the applicant.
