Heard learned counsel for the applicant, learned A.G.A. and also perused the record.
The present bail application filed on behalf of Sanjay Yadav seeking his bail in connection with Case Crime No.760 of 2017, u/s 302, 201 I.P.C., P.S.- Bisrakh, District- Gautam Buddh Nagar.
Submission made by the learned counsel for the applicant that trial is in progress. Five witnesses has been examined so far. The trial court is making all necessary effort to conclude the trial at the earliest. Learned counsel for the applicant submits that non-bailable warrant was issued against witnesses to procure the attendance.
However, it is expected from the learned trial court to gear up and conclude the trial preferably by the 30th June, 2021, without granting unnecessary adjournment to either of the parties provided the parties would render fullest corporation in early conclusion of the trial.
It is incumbent upon the applicant to apprise/ serve the copy of this order to the court concern by 15th December, 2020 positively so that the learned trial judge chalk out his program for concluding the trial by aforesaid date.
In view of the above observation, the second bail application stands rejected.
