It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case with malafide intention. He further argued that the case rests on the circumstantial evidence.The deceased was sister-in-law (Bhabhi)of the applicant. There was some dispute between the complainant and his wife (deceased) because the complainant suspected that the deceased was a woman of bad character, on account of which she left her husband and gone away and thereafter her dead body was found from a canal and after eleven days of the incident, the present F.I.R. was lodged by the husband of the deceased against the applicant and one Bholu @ Shiva Kant. He further argued that the applicant is a Constable in Air Force and he was posted at Air Force Station Basant Nagar, Delhi, Cantt. and during the course of investigation, the investigating officer arrested him on 25.1.2020, the said fact has been mentioned in paragraph no.10 of the affidavit filed in support of the bail application. He next argued that the informant who is brother of the applicant wanted to grab the agricultural land of the applicant because the applicant is a Government employee and is living in Delhi whereas the complainant is living in village, the said fact has been mentioned in paragraph no.18 of the affidavit filed in support of the bail application. He next argued that there is no eye witness account of the incident and only on the basis of statement of one Dharmendra recorded under Section 161
