This bail application has been moved to enlarge the applicant on bail in Case Crime No. 0040 of 2020, under sections 376, 323, 504 I.P.C., Police Station Shankargarh, District Prayagraj.
The victim is deaf and dumb; her modesty was outraged by the applicant who is known to her; she has supported the prosecution version in her statement recorded under section 164 Cr.P.C.
It is urged by learned counsel for the applicant that the parties have compromised out side the Court.
Learned A.G.A. has vehemently opposed the prayer for bail and submits that the offence is not compoundable and is against the society and State. It is not in the public interest to enlarge the applicant on bail
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant.
Accordingly, the bail application is rejected.
The trial court is directed to expedite the trial of the aforesaid case and conclude the same expeditiously on day to day basis from the date of production of a copy of this order downloaded from the official website of the High Court.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
The party shall file computer generated copy of this order downloaded from the official website of High Court Allahabad.
The computer generated copy of the order shall be self attested by the counsel of the party concerned.
