Heard learned counsel for the applicant and the learned A.G.A. On an earlier petition being Criminal Misc. Anticipatory Bail Application U/S 438 Cr.P.C. No. 1105 of 2020, the Court had permitted the applicant to withdraw that petition with liberty to file fresh before the Court of Sessions. Despite that order the applicant has chosen to prefer the instant petition. Accordingly while this petition is dismissed , it is left open to the applicant, if so advised, to initiate appropriate proceedings before the concerned District Court.
