Heard learned counsel for the applicant and learned AGA for the State.

This application under Section 482 Cr.P.C. has been moved by applicant to direct the concerned Court below to decide the Session Trial No. 399 of 2011, State versus Mahavir and others (Crime No. 33 of 2011), under Sections 147, 148, 149, 302, 307, 34 IPC and 7 Criminal Law Amendment Act, Police Station Malwan, District Fatehpur within stipulated period as fixed by this Court.

Learned counsel for the applicant submits that the trial is pending before the Court below since 2011 and trial Court is not taking any interest in disposal of the case. Progress of trial is very slow, therefore, he wants early disposal of the trial. He further submits that a direction has already been issued on 09.04.2018 in Criminal Misc. Bail Application No.9206 of 2017 filed by co-accused Veeran but the same has not been complied with. The operative portion of the order is quoted below:-

"However, considering the fact that applicant is languishing in jail since 6.3.2011, the trial court is directed to expedite the trial of aforesaid case and conclude the same in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of two months from the date of production of a certified copy of this order, if there is no legal impediment."

Learned AGA has no objection to aforesaid request.

Considering over all circumstances of the case and contention of learned Counsel for the parties; the present application is disposed of with the direction to the trial Court concerned to decide the aforesaid Session Trial, in the light of direction issued in Criminal Misc. Bail Application No.9206 of 2017, within a period of two months, from the production of a certified copy of this order before him, if there is no legal impediment.
