Heard Sri Rajeev Kumar Singh Parmar, learned counsel for the applicant and learned AGA for the State.
This application under Section 482 Cr.P.C. has been moved by applicant to direct the concerned Court below to decide the Session Trial No. 833 of 2012, State versus Sarvesh Shukla and others (Crime No. 642 of 1999), under Sections 147, 148, 302, 307 IPC, Police Station Kotwali, District Kanpur Nagar pending in the Court of Additional Sessions Judge 10th, Kanpur Nagar within stipulated period as fixed by this Court.
Learned counsel for the applicant submits that the trial is pending before the Court below since 2012 and trial Court is not taking any interest in disposal of the case. Progress of trial is very slow, therefore, he wants early disposal of the trial.
Learned AGA has no objection to aforesaid request.
Considering over all circumstances of the case and contention of learned Counsel for the parties; the present application is disposed of with the direction to the trial Court concerned to decide the aforesaid Session Trial within a period of three months from the production of a certified copy of this order before him, if there is no legal impediment.
