The brief facts of the case for adjudication of the present controversy are that a complaint has been filed by the opposite party no.2 before the Chief Judicial Magistrate, Hapur on 16.08.2017 with the allegations that the complainant/opposite party no.2, who is reputed businessman and Director of G.B. Builders, was having friendly relationship with the applicant. The applicant took sum of Rs. 7 lacs in cash from the complainant/opposite party no.2. Subsequently, when the complainant/opposite party no.2 demanded the said amount, the applicant gave different cheques of different amount, however, upon presentation of the said cheques before the concerned bank, the same were dishonoured. When the information about the said cheques was given to the applicant, he gave another cheque of Rs. 5 lacs, which was also dishonoured due to insufficient fund. Consequently, the complainant/opposite party no.2 gave notice to the applicant but the applicant did not pay attention on the same, therefore, the present complaint has been filed.
