Learned counsel for the applicant submitted that the applicant is in custody in Case Crime No. 271 of 2019, under Sections 302, 120-B I.P.C. and 3/25/30 Arms Act, P.S. Rampura, DistrictJalaun. The F.I.R. was registered against co-accused Madindra Maharaj @ Vijay Shanker @ Kallu alleging therein that applicant and co-accused Madindra Maharaj threatened the son of first informant and detained him in his field and on 26.12.2019 murdered the first informant's son and applicant and co-accused have been implicated. The applicant moved bail application under Section 167 (2) of Cr.P.C. on 23.4.2020 and the learned Chief Judicial Magistrate, Jalaun at Orai vide order dated 1.5.2020 rejected the bail application of the applicant, thereafter, the applicant against the order dated 1.5.2020 has filed a criminal revision in the court of District & Sessions Judge, Orai at Jalaun on 17.7.2020. He further submitted that applicant's criminal revision regarding bail under Section 167 (2) of Cr.P.C. is pending before the District & Sessions Judge, Orai at Jalaun and the revisional court is not hearing the criminal revision of the applicant, but granting general dates. The applicant is in jail since 26.3.2020.
