Heard Sri Rakesh Kumar Tripathi, learned counsel for the petitioner, Sri Ram Chandra, Advocate holding brief of Sri Pranjal Mehrotra and learned A.G.A. for the State.
The instant petition under Article 227 of Constitution of India has been filed for directing the Court below to decide the objection of applicant dated 15.10.2011 of Case No.3932 of 2010 (State Vs. Krishna Kumar Sharma) u/s 26(2), 28(1), 28(2) UPADA, P.S. Goal Park, District Aligargh and further to direct the Court below to decide the above noted case in stipulated period, which is pending before C.J.M., Aligarh.
Learned counsel for the petitioner submits that proceedings under Sections 26(2), 28(1) and 28(2) have been initiated against petitioner with absolutely false and incorrect allegations against which petitioner has filed objection on 15.10.2011; that matter is pending before C.J.M., Aligarh since last around 9 years and petitioner is being harassed unnecessarily as respondent is not producing evidence while all the witnesses are official witnesses.
Learned counsel for A.D.A. submits that respondent is not delaying the disposal of trial and he is ready to produce witnesses without seeking unnecessary adjournment.
Upon hearing learned counsel for the parties and perusal of record, the petition is disposed of with direction to trial court concerned for expeditious disposal of Crl. Case No.3932 of 2010 under Sections 26(2), 28(1) and 28(2) UPADA, P.S. Goal Park, District Aligarh expeditiously in accordance with law without granting unnecessary adjournment to either party if possible, within three months.
The petition is accordingly, disposed of .
