Learned counsel for the petitioner orally prays that this petition may be treated as falling under Article 227 of the Constitution. Prayer so made is granted.

Further necessary amendments in the prayer clause be carried out within two days.

This petition impugns the order passed by the Additional District Judge setting aside the order passed by the Trial Judge on the application for interim injunction.

When the instant writ petition was entertained on 26 September 2008, an order of status quo was passed which has continued till date. In view thereof, learned counsels submitted that the ends of justice would merit directions being framed for expeditious disposal of the suit itself and the order of status quo as provided by the Court to continue till the disposal thereof.

Accordingly, the instant writ petition is disposed of with a direction that the concerned Trial Judge ceased of O.S No. 625 of 2007 shall endeavour to dispose of the same in accordance with law and preferably within a period of one year from the date of presentation of a certified copy of this order. For the aforesaid period or till the disposal of the suit itself which ever be earlier, the parties shall maintain status quo on spot over the suit property with regard to the nature and condition of land in question.

Learned counsels on instructions state that parties shall co-operate in expeditious disposal and not seek any unnecessary adjournment.
