This writ petition has been filed, interalia, for the following reliefs:

"(I). Issue a writ, order or direction in the nature of Certiorari quashing the impugned order dated 07.10.2019, 05.11.2019 and notification dated 30.11.2019 issued by the respondent no. 1-Chief Manager, Bharat Petroleum Corporation Limited, R.N.P. U.P. Building UPSCIDCO Building 5th Floor TC/46V, 5th Floor, Vibhuti Khand, Gomti Nagar, Lucknow-226010 (Annexure No. 4, 6 and 11 of the writ petition respectively).

(II) Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 1- Chief Manager, Bharat Petroleum Corporation Limited, R.N.P. U.P. Building UPSCIDCO Building 5th Floor TC/46V, 5th Floor, Vibhuti Khand, Gomti Nagar, Lucknow-226010 to consider the objection/explanation of the petitioner and allot the Retail Outlet (Petrol Pump) proposed to be set up on Village Sathiwan, Block Fazil Nagar, Tehsil Kasya, Baghauch Road, District Kushi Nagar. "

Heard learned counsel for the parties and perused the record.

Learned counsel for the petitioner states that impugned order has been passed without giving notice/opportunity of hearing to the petitioner. He

further submits that petitioner may be permitted to file objection before Respondent No. 1 in respect of his grievances.

Considering the facts and circumstances of the case, this writ petition is disposed of with liberty to the petitioner to file objection before Respondent No. 1 within 15 days from today and in case any such objection is filed, the same shall be decided preferably within a period of six weeks from the date of receipt of certified copy of this order after giving opportunity of hearing to the petitioner.

For a period of eight weeks or till the passing of the final order by Respondent No. 1, whichever is earlier, Respondent No. 1 shall not proceed further pursuant to the orders/letters dated 07.10.2019, 05.11.2019 and notification dated 30.11.2019.

It is made clear that this Court has not expressed any opinion with regard to the merit of the case.

The concerned respondent shall consider and decide the matter on its own merit.
