Petitioner prays for a direction to be issued to Respondent No.2, District Magistrate, Kasganj to take appropriate decision on the complaint submitted by the petitioner on 11.3.2019 in terms of Rules 3 of the U.P. Panchyat Raj (Removal of Pradhan, Up Pradhan and Members) Enquiry Rules, 1997.

This Court has considered the pleadings and also the submissions of the learned counsel appearing on behalf of the petitioner.

It has been submitted that the petitioner has filed the complaint under the Rules of 1997 duly supported by an affidavit and all documentary evidence including Panchyat Activity Plan Reports 2016-17, 2017-18, 2018-19, 20192020 by which funds of several schemes were allotted for development work of Gram Panchyat that the Gram Pradhan is not taking any interest in the matter. But the District Magistrate has also not taken heed of such complaint and even preliminary inquiry has not been initiated.

This petition is disposed of with a direction to the opposite party no.2 to consider the complaint made by the petitioner made by him on 11.3.2019 and then pass appropriate orders thereon either initiating a preliminary inquiry or

disposing of the said complaint by a reasoned and speaking order within a period of three months from the date a certified copy of this order is produced before him. Order Date :- 18.11.2019 Manish Tripathi
