Heard learned counsel for the parties.

The petitioners have taken admission in three years law programme for the session 2013-2016 in Daya Nand College of Law, Kanpur Nagar bearing Roll Numbers 0904361 and 0802233 respectively.

The petitioner no.1 wants to appear in the back paper examination of IIIrd and IVth papers of third semester, and petitioner no.2 wants to appear in the Ist and IIIrd paper of fifth semester.

The grievance of the petitioners are that University is not permitting them to appear in the back paper in the aforesaid subjects and as such, petitioners pray for a wit of mandamus directing the respondents to permit them to appear in the back paper examination in the aforesaid subjects.

Learned counsel for the University submits that in case, petitioners approach respondent no.3 Examination Controller, Chatrapati Sahu Ji Maharaj University, Kanpur Nagar, he will consider the grievance of the petitioners.

Having consider the submissions of the parties and considering the facts and circumstances of the case, the writ petition is disposed of with liberty to the petitioners to submit a representation before the respondent no.3 Examination Controller raising all their grievances within a period of one week from today, and if any representation is filed, the

respondent no.3 shall consider and decide the same in accordance with law within a period of two weeks thereafter.

The writ petition is disposed of.
