Heard learned counsel for the petitioner, learned Standing counsel and Sri Abhishek Srivastava for respondent no. 3.

The petitioner by means of this writ petition has challenged the recovery citation dated 16.9.2019 of Rs. 2,08,365/- as electricity dues.

Sri Abhishek Srivastava, learned counsel for respondent no. 3 on the basis of instructions received by him informs that on the basis of checking report dated 18.7.2018 petitioner was assessed to unauthorize use of electricity vide order dated 21st July 2018 and the copy of this provisional assessment was sent to him by speed post on 25th July 2018.

Since objections were not received from the side of the petitioner treating the said provisional assessment to be final, the impugned recovery has been sent to him.

The submission of learned counsel for the petitioner is that he has not received any such copy of the provisional assessment so as to permit him to file objections.

In view of the aforesaid facts and circumstances, in the interest of justice, we dispose of this writ petition with the direction to the petitioner to file objections, if any, against the aforesaid provisional assessment, a copy of which has been supplied to the counsel for the petitioner during the course of hearing within a period of two weeks from today. In the event any objections are filed, the Executive Engineer shall consider and decide the same by a speaking order in accordance with law most expeditiously, if possible, within a month thereafter.The recovery shall abide by the aforesaid decision of the Executive Engineer.
