Shri S. K. Pundir, learned counsel has filed an application seeking impleadment on behalf of co-owner of the property. The impleadment application is taken on record.
Heard Shri Dhirendra Kumar Srivastava, learned counsel for the petitioner, Shri Krishna Agarwal, learned counsel for the respondent nos. 2, 3 and 4 and Shri S. K. Pundir, learned counsel for co-owner.
At the very out set, learned counsel for the respondent corporation has raised preliminary objection regarding maintainability of the writ petition on the ground that Shri Bijendra Gupta has not applied for electricity connection, but the same has been applied by One India Family Mart/ M/s Nayasa Retail Private Limited. In view of above, he submits that the petitioner cannot be aggrieved person.
At this stage, learned counsel for the petitioner submits that he may be permitted to withdraw this writ petition, as far as petitioner is concerned.
