Heard Sri Chetan Chatterjee, learned Counsel for petitioner, learned Standing Counsel for State-respondents and Sri Satendra Pratap Singh, learned Counsel for respondent 3.

Learned Counsel for petitioner submitted that petitioner deposited certain amount towards development charges etc. for carry out development work as per lay out plan and still some amount has remained to be paid to the Authority which petitioner could not arrange due to difficult circumstances, which has arisen in the city in question. Petitioner has prayed respondent 3 to cancel his plan since no development has been undertaken on the land in question and refund the entire amount deposited for the purposes of carrying out development as per lay out plan. In paragraph 26, petitioner has categorically stated that no development has taken.

However, this is a matter of investigation, therefore, petitioner may move a detailed representation before respondent Authority concerned, raising all the grievances as raised in this petition, which shall be considered and decided expeditiously and preferably within a period of three months form the production of certified copy of this order.
