Heard Sri Sankalp Narain, learned counsel for the petitioners and learned Standing Counsel for the State.

The petitioners made a claim attestation of signature of the petitioner no. 2 as Manager of the Institution, on the foot of an election before the District Inspector of Schools. The District Inspector of Schools was directed by the Joint Director of Education, 1st Region, Meerut to process the election claim set up by the petitioners.

The submission made by learned counsel for the petitioners, is that the claim of the petitioners, for attestation of signature of the petitioner no. 2, and validation of election has not been decided till date.

The only prayer made by learned counsel for the petitioners, is that the claim of the petitioners for attestation of the signatures, may be decided within a stipulated period of time.

Learned Standing counsel submits that the District Inspector of Schools is under on obligation of law to decide the claim of the petitioners within a reasonable period of time.

No useful purpose would be served while keeping the writ petition pending.

The matter is remitted to District Inspector of Schools, Baghpat.

A writ of mandamus is issued commanding the District Inspector of Schools, Baghpat to decide the claim for approval of election and application for attestation of the signatures of petitioner no. 2, on the foot of such election as set up by the petitioners, within a period of one month from the date of receipt of a certified copy of this order.

This Court has not gone into the veracity of the assertions made in the writ petition nor has the claim of the petitioners been judged on merits. The competent authority shall apply its mind and return independent findings on the controversy.

The writ petition is disposed of.
