Learned counsel for the petitioner is permitted to implead "Secretary, Board of High School & Intermediate Education, U.P., Prayagraj" as party respondent No.5 in the array of the parties to the writ petition during the course of the day.

The petitioner has made a representation for mark-sheets of the students who sat in the High School and Intermediate examination conducted by the respondent-Board. The only prayer made by the learned counsel for the petitioner is that the mark-sheets of the students of the Institution may be issued by the respondent Board within a stipulated period of time.

Learned Standing Counsel for the respondent-State fairly submits that the Board is under obligation of law to issue marks-sheet to all students who appeared in the examinations conducted by the Board.

No useful purpose will be served by keeping the petition pending.

The matter is remitted to the respondent No.5-Secretary, Board of High School & Intermediate Education, U.P., Prayagraj.

A writ of mandamus is issued commanding the respondent No.5-Secretary, Board of High School & Intermediate Education, U.P., Prayagraj to provide the mark-sheets of the students of the Institution within a period of one month from the date of receipt of a certified copy of this order along with a detailed representation in this regard.

The Court has not gone into the veracity of the assertions made in the writ petition nor has the claim of the petitioner been judged on merits. It is for the competent authority to do so after independent application of mind.

With the aforesaid direction, the writ petition is finally disposed off.
