The writ petition has been filed for issuance of mandamus directing the respondents not to interfere in peaceful possession of the petitioner's allotted house and to inform about outstanding dues so that it can be deposited by him. It has been stated that the petitioner was allotted house No.377 E.W.S. Gunjan Vihar-Barra-6 in Gunjan Vihar Scheme of Kanpur Development Authority on 22.11.1988. Thereafter, he deposited various instalment amount and petitioner want to deposit entire outstanding dues amount and in this regard he moved an application before Secretary/Vice Chairman, Kanpur Development Authority on 28.05.2019.
In the facts and circumstances of the case, the writ petition is disposed of directing the Secretary/Vice Chairman, Kanpur Development Authority-respondent no.3 to decide the representation of the petitioner dated 28.05.2019 by a reasoned and speaking order within one month from the date of production of a certified copy of this order.
The petitioner is given liberty to file a certified copy of this order as well as a photostat copy of representation dated 28.05.2019 as well as receipt relating to deposits made by him before the Secretary/Vice Chairman, Kanpur Development Authority-respondent no.3 within 10 days from today.
