Heard Sri Pankaj Kumar Shukla holding brief of Ms. Ruchi Mishra, learned counsel for the petitioner and Sri Sanjay Kumar Pandey, learned Standing Counsel appearing for Respondent Nos. 1 and 2.
By means of the present petition, the petitioner has sought a direction to Respondent No.2, the Naiab Tehsildar Vikaramjot, Tehsil-Harriya, District Basti to decide the Mutation Application No. 578 (Premadavi vs. Ramkumar), under Section 34 of the Land Revenue Code, 2006 within a stipulated period.
Learned counsel for the petitioner submits that the petitioner would appear before the court below in the pending matter and would not seek any unnecessary adjournment, and a direction may be issued for the pending matter to be decided within a reasonable time period.
Learned Standing Counsel appearing for respondent nos. 1 and 2 has no objection to the prayer so made.
With the consent of the parties the petition is disposed of with an observation that in case the petitioner appears before the court below and does not seek any unnecessary adjournment, it is expected that the court below would make an endeavour to decide the aforesaid case expeditiously in accordance with law, preferably within three months from the date of presentation of a certified copy of this order, if there is no other legal impediment.
