This writ petition has been filed, inter alia, for the following reliefs:

"(i) Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to issue a no objection certificate for installing a tank for storing petroleum products of Grade A and Grade B (white kerosene oil) within stipulated period as fixed by this Hon'ble Court.

(ii) Issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 to decide the application of the petitioner dated 09.05.2017 for issuing No Objection Certificate within the time stipulated by this Court."

Learned counsel for the petitioner has confined his prayer only to the extent that the petitioner may be permitted to make a fresh representation before the concerned authority in respect of his grievances with a direction to the concerned authority to decide the same within the stipulated period .

Heard learned counsel for the parties and perused the record.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this writ petition is finally

disposed of with a direction to the petitioner to make a fresh representation before the respondent no.2- District Magistrate, Maharajganj ventilating his grievances within three weeks from today along with a certified copy of this order enclosing therewith a copy of the writ petition and its entire Annexures and, if any such representation is made, the said authority shall make all endeavours to consider and decide the same in accordance with law expeditiously preferably within 60 days from the date of receipt of the said representation.
