Heard Sri Ajay Kumar, learned counsel for the petitioner, Sri Neeraj Dube, learned counsel appearing for Respondent No.4 and the learned Standing Counsel for Respondent Nos. 1, 2, 3, 5 and 6.

By means of the present writ petition the petitioner seeks a direction to the respondents to pay compensation to the petitioner and other co-sharers of the land, i.e., Khasra Nos. 44, 44-Ka, 44-Kha, 44-Ga, situate in Village Mahanandpur, Pargana and Tehsil Bhogaon, District Mainpuri which is said to have been acquired for the construction of National Highway.

The petitioner claims that the land in question is an ancestral property. However, no material document has been placed on record to demonstrate the right or title of the petitioner over the land in question. Moreover, as per his own case there is a partition suit pending in respect of property and as such the petitioner is not entitled for relief as prayed for.
