Heard learned counsel for the petitioners. Learned Standing Counsel accepted notice on behalf of respondent Nos.1 and 2. In view of the order proposed to be passed, notices need not go to the respondent No.3.

The only prayer pressed by learned counsel for the petitioners in the present writ petition is that to direct the Settlement Officer Consolidation/respondent No.2 to pass appropriate orders on the Stay Application filed in Appeal No.213 of 2019 (Surendra Singh Vs. Kali Charan) under Section 11(1) of U.P. Consolidation of Holdings Act, 1953.

It is contended that although along with memo of appeal, application for grant of injunction was also filed but till date no orders were passed on the said application by the appellate authority.

Learned Standing Counsel has no objection to the prayer made by the petitioners.

In view of the above, without expressing any opinion on merit of the case, this petition is disposed of with the direction to the respondent No.2/Settlement Officer of Consolidation Auraiya to pass appropriate orders on the stay application filed in Appeal No.213 of 2019 (Surendra Singh Vs. Kali Charan) under Section 11(1) of U.P. Consolidation of Holdings Act, 1953 by the petitioners strictly in accordance with law as expeditiously

as possible, preferably within a period of three months from the date of production of certified copy of this order.
