The petitioner claims that she is senior most assistant teacher in Jai Kisan Inter College, Lalpur Imiliyadheesh, Basti and she should be given charge of the post of officiating Principal, which is vacant consequent to retirement of the incumbent on 31.3.2019. The claim of the petitioner is backed by the Committee of Management, as is evident from its letter dated 9.4.2019, wherein the Manager had requested the District Inspector of Schools to attest the signatures of the petitioner as officiating Principal. It also appears from the material brought on record that respondent no.6 is also staking claim for the same post. The District Inspector of Schools on 9.4.2019 has directed the Management to take appropriate action in the matter.
According to learned counsel for the petitioner, the District Inspector of Schools has yet not taken any decision in the matter.
Learned standing counsel states that District Inspector of Schools (respondent no.4) is competent to examine the claim of the petitioner vis-a-vis Ashok Kumar Pandey, respondent no.6.
Accordingly, the instant petition is disposed of with direction to the fourth respondent to examine the claim of the petitioner as well as respondent no.6 or any other rival claimant within a period of four weeks from the date of receipt of a certified copy of this order, after hearing the parties.
