It is contended by the learned counsel for the petitioner that the petitioner was duly appointed on the post of Shiksha Mitra on 22.11.2002. Subsequently, the petitioner had been falsely implicated in a criminal case being Case Crime No.245 of 2014 under Sections 376 IPC and 3/4 POCSO Act. In this regard, the petitioner had been arrested and confined in Jail between 29.06.2014 and 23.07.2014. The petitioner has been discharged from the criminal case on 23.07.2014. It is contended in paragraph 7 of the writ petition by learned counsel for the petitioner that due to the fact that the petitioner had been sent to the jail, the respondent denied to appoint the petitioner on the post of Assistant Teacher. Thereafter the petitioner filed a Writ Petition No.48088 of 2016 (Rajendra Prasad Vs. State of U.P. and others.) The said writ petition is finally decided on 22.11.2016. It is contended in paragraph 8 of the writ petition that although the petitioner is discharging the duties on the post of Shiksha Mitra till date but the honorarium/salary of the petitioner for the period between 1.8.2014 till 14.05.2017 was not paid to the petitioner. It is further contended that with effect from 15.05.2017, the petitioner is getting his salary regularly. It is further contended by the learned counsel for the petitioner that since the salary for the aforesaid period was not paid to him, he made a representation to the District Basic Education Officer, Badaun on 18.2.2019 but till date no action has been taken.
