The present habeas corpus writ petition has been filed on behalf of the corpus Uma through her husband namely Raju. The contention of the counsel for the petitioner is that the girl is an adult; that she has solemnized marriage with Raju on her own sweet will without any fear, threat or coercion; much reliance has been placed on the statement of the girl under Section 161 Cr.P.C. and 164 Cr.P.C., copies of which has been annexed on page nos. 20 and 25 of the affidavit filed in support of the writ petition. The further contention is that even if the certificate issued by the Principal of Junior High School, Patanpur, Maudaha, Hamirpur, the date of birth of the girl has been mention as 01.07.2001, copy of which is annexed on page no.29 of the affidavit filed in support of the writ petition. It has been further informed to the Court that the girl at present is carrying pregnancy of two months, as mention in paragraph no.9 of the affidavit filed in support of the writ petition. Thus the contention is that no purpose will be served in keeping this girl at Rajkiya Mahila Sharnalaya, Kanpur, the respondent no.2.
