The applicant Nos.1 to 5, namely, Sri Harish Chandra Sharma, Hitesh Chadra Sharma, Yogesh Chandra Sharma, Vijay Kumar Sharma and Rakesh Kumar Sharma are sons of late Sohan Lal. The applicant Nos. 6 & 7, namely, Sri Subhash Sharma and Satish Kaushik are sons of Jagdish Prasad. According to the applicants, the land of father of the applicants as well as father of the co-sharer was acquired for the Ghaziabad Development Authority. They were illiterate villager. A common reference being L.A.R. No.47 of 1989 (Sohan Lal Vs. State of U.P.) was filed under Section 18 of the Land Acquisition Act, 1894 which was decided by the common judgment dated 4.4.1991, passed by the 6th Additional District Judge, Ghaziabad, alongwith 30 other references. The father of the applicants believed that First Appeal Defective No.641 of 1992 must have been filed on behalf of the cosharer also. Subsequently, father of the applicants died and after his death the applicants came to know that appeal has not been filed on behalf of the father of the applicants, namely, Sri Sohan Lal and Jagdish Prasad. On coming to know this fact the applicants have moved the present transposition application to transpose the names of the applicants as appellants in the above noted First Appeal.
