We find that Reference Court has referred to various exemplars of corresponding period of 8th January, 1979, 21st March, 1979, 28th February, 1979, 15th January, 1979 and 23rd April, 1979, whereby land was transferred by sale at Rs.50/-, Rs.90/-,Rs.100/- and Rs.87.50 per square yard. All these exemplars are of the period much prior to the date of Notification under Section 28 i.e. 11st August, 1979. The general law is that exemplar which provides highest rate should have been followed. Reference Court found, when land which is subject matter of sale deed is of smaller size, an appropriate deduction need be applied. However, since there was already an award dated 28th April, 1987 which had become final, it followed the same and determined compensation accordingly. This fact is not disputed before us. Once appellants have accepted an award determining a particular rate in respect of one of similar category land, applying belting system, we find no justification on the part of appellants to challenge the same determination of rate in this appeal since, respondents are also entitled for same treatment. Moreover, from the award, it is also evident that most of land is in the category of second belt and only a smaller part of land is in first category and third category.
