No one appears on behalf of the respondents even in the revised call.
By notification under Section 4(1) of the Land Acquisition Act, 1894 published in the gazette on 06.04.1989, land measuring 184.458 acres of Village Pawi Sadikpur, Pargana Loni, Tehsil and District Ghaziabad, were acquired for U.P.S.I.D.C.
Learned counsel for the appellant states that similar first appeal arising from the same acquisition being First Appeal No.881 of 2004 (U.P.S.I.D.C. through its M.D. Vs. Satya Narain and another) was dismissed by a Division Bench judgment dated 05.08.2015. She further states that another similar First Appeal No.911 of 2004 (U.P.S.I.D.C. through its M.D. Vs. Subhash Chand Gupta) was dismissed by the same Division Bench by a judgment dated 10.09.2015. She, therefore, states that in view of the aforesaid two Division Bench judgments, present first appeal also deserves to be dismissed.
In view of the statement made by learned counsel for the appellant, this appeal is also dismissed.
